Care Carry connects Canadian families with certified, independent caregivers. We facilitate discovery, bookings, communication, and payments. You are responsible for lawful use of the platform and for meeting your tax and compliance obligations. Please review the full Terms below.
Acceptance of Terms
By accessing or using Care Carry, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with these Terms, you may not use the platform.
These Terms apply to all users, including families, caregivers, and visitors. Additional terms may apply to specific features (e.g., payments, messaging, or onboarding).
Eligibility
You must be at least the age of majority in your province or territory of residence in Canada to create an account and use Care Carry.
Caregivers must meet identity, certification, and background verification requirements. Families must provide accurate information for the care recipient and service location(s).
Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information, and to update it as needed. We may suspend or terminate accounts that violate these Terms or applicable laws.
Platform Services
Care Carry connects families with independent, certified caregivers for at-home care. We facilitate discovery, scheduling, communications, and payments.
Care Carry is not a healthcare provider and does not employ caregivers. Caregivers provide services as independent contractors unless explicitly stated otherwise by applicable law.
Bookings & Cancellations
Bookings must comply with platform policies, including minimum booking durations and cancellation windows where applicable.
You agree to verify caregiver availability and service location accuracy. Changes or cancellations should be made through the platform to ensure proper tracking and communication.
Payments, Fees & Payouts
Payments are processed through our third-party payment provider. You authorize charges for booked services and agree to our platform fee structure.
Caregiver payouts are made to connected accounts, subject to provider terms, holds, dispute resolution, and applicable minimum payout thresholds.
Tax Compliance (Canada)
Families may be considered employers of independent contractors for tax purposes. Care Carry provides tools to assist with T4 reporting; however, you are responsible for ensuring compliance with CRA requirements.
We may generate documents (e.g., summaries or forms) to facilitate reporting, but we do not provide tax, legal, or accounting advice. Please consult a qualified professional.
User Conduct
You agree not to misuse the platform, including by posting false information, harassing other users, violating privacy, or engaging in unlawful activity.
We may, at our sole discretion, remove content, suspend features, or terminate accounts to protect users and maintain platform integrity.
Privacy & Data
Your use of the platform is also governed by our Privacy Policy. We implement security and privacy practices aligned with Canadian laws, including PIPEDA, where applicable.
Do not share protected or sensitive health information beyond what is necessary for caregiving. Use built-in tools for secure communication and document sharing.
Intellectual Property
All platform content, trademarks, logos, and software are the property of Care Carry or its licensors and are protected by applicable laws.
You may not copy, modify, distribute, or create derivative works from our content except as expressly permitted.
Disclaimers
Care Carry provides the platform on an "as is" and "as available" basis, without warranties of any kind, express or implied.
We do not guarantee the accuracy of user profiles, availability, or outcomes of caregiving services. Background checks and verifications reduce risk but do not eliminate it.
Limitation of Liability
To the maximum extent permitted by law, Care Carry shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Our aggregate liability arising out of or relating to the platform shall not exceed the greater of CAD $100 or the total fees paid to us by you in the three (3) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Care Carry and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the platform, your content, or your violation of these Terms.
Suspension & Termination
We may suspend or terminate access to the platform for violations of these Terms, suspected fraud, risk to users, or compliance requirements.
You may discontinue use at any time. Certain obligations (including payment and legal responsibilities) survive termination.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict of law principles.
Disputes will be resolved through good-faith negotiation. If unresolved, the parties agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
Changes to Terms
We may update these Terms from time to time. Material changes will be indicated by updating the "Last Updated" date and, where appropriate, by providing additional notice within the platform.
